For purchased gift cards
California Civil Code section 1749.5 generally prohibits expiration dates and service fees on sold gift certificates, subject to statutory exceptions. A sold gift certificate without an expiration date remains valid until redeemed or replaced.
Cash redemption
As of the version of section 1749.5 operative April 1, 2026, a gift certificate with a cash value under $15 is redeemable in cash for its cash value, subject to statutory exceptions.
Who is the issuer?
If the card is issued by a Local Host sponsor, that sponsor is the issuer and should clearly state where and how it can be used. Local Host should not imply it guarantees a sponsor's solvency or redemption unless Local Host is actually the issuer.
Promotional cards
Some promotional, loyalty, nonprofit fundraising and other cards can fall within special exceptions. The issuer should confirm the exact rule before using an expiration date.
